1. Acceptance of Terms

By accessing or using FlightBoard (“Service”) at flightboard.app, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These terms apply to all users, including club owners, admins, members, and A&P mechanics.

2. Description of Service

FlightBoard is a web-based flying club management platform that provides tools for aircraft scheduling, reservation management, flight logging, maintenance squawk tracking, and inspection record keeping. The Service is provided on a subscription basis.

3. Aviation Disclaimer

FlightBoard is a scheduling and recordkeeping tool only. It is NOT a substitute for:

  • Official FAA-required aircraft logbooks or maintenance records.
  • Airworthiness determinations by a certificated A&P mechanic or IA.
  • Pilot flight logs required by 14 CFR Part 61.
  • Compliance with any FAR/AIM requirement.

Information entered in FlightBoard does not replace any legally required documentation. You are solely responsible for maintaining records required by applicable aviation regulations.

4. Eligibility, Geographic Scope, and User Accounts

FlightBoard is offered solely to users located in the United States.

By creating an account or using the Service, you represent and warrant that you are located in, and are accessing and using the Service from, the United States. The Service is not directed to, and we do not intend to offer or market it to, individuals or organizations located in the European Union, the European Economic Area, the United Kingdom, or any other jurisdiction outside the United States. We make no representation that the Service, its content, or its data practices are appropriate for or comply with the laws of any jurisdiction outside the United States, and you are responsible for compliance with your local laws. We may decline, suspend, or terminate access we reasonably believe originates from outside the United States.

You are responsible for maintaining the confidentiality of your account credentials. Club owners are responsible for all activity that occurs under their club account, including activity by invited members. You must notify us immediately of any unauthorized use of your account.

Each account must have a valid email address. You may not create accounts for others without their consent. You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Service.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose.
  • Attempt to gain unauthorized access to other clubs’ data.
  • Reverse engineer, scrape, or copy the Service.
  • Upload malicious code or attempt to disrupt the Service.
  • Impersonate another person or club.
  • Upload, post, or share content that is unlawful, obscene, pornographic, sexually explicit, or that sexually exploits or endangers a minor (including child sexual abuse material, which we report to the National Center for Missing & Exploited Children and law enforcement as required by law).
  • Upload content that infringes another’s intellectual property, or that depicts an identifiable person or their private information without their consent.
  • Upload harassing, defamatory, hateful, threatening, or violent content.

6. Subscriptions and Billing

Paid plans are billed monthly through Stripe. Subscriptions renew automatically unless cancelled. You may cancel at any time from your account settings; cancellation takes effect at the end of the current billing period.

We reserve the right to change pricing with 30 days notice. Free plan features may be adjusted at any time.

Trial periods: Paid plan trials are provided at our discretion. At the end of a trial, the account reverts to the free plan unless a payment method is provided.

7. Data Ownership

You retain ownership of all data you enter into FlightBoard (flight logs, reservations, squawks, inspection records, etc.). We do not claim ownership of your data. You grant us a limited license to store and process your data solely to provide the Service.

You may export your data at any time. Upon account closure, your data will be deleted within 30 days.

8. User-Generated Content

Some features let you upload or post content such as photos, comments, and documents (“User Content”). You retain ownership of your User Content. You grant FlightBoard a worldwide, non-exclusive, royalty-free license to host, store, reproduce, and display your User Content solely to operate and provide the Service to you and the members of your club.

Your responsibilities. You represent and warrant that you own or have all necessary rights to the User Content you upload; that it does not infringe any third party’s intellectual-property or privacy rights; that you have consent from any identifiable person depicted; and that it does not violate the Acceptable Use section or any law.

Our right to remove. We do not pre-screen User Content, but we may review, remove, disable, or restrict access to any User Content, and suspend or terminate any account, at any time and without notice, if we believe it violates these Terms or the law or creates risk or liability. Content that violates a person’s privacy or intellectual-property rights, or that is otherwise prohibited, will be removed. We are not responsible for User Content posted by users.

9. Copyright and Takedown (DMCA)

We respect intellectual-property rights and respond to clear notices of alleged copyright infringement. If you believe content on the Service infringes your copyright, send a notice to support@flightboard.app including: identification of the copyrighted work; the location (URL) of the material; your contact information; a statement that you have a good-faith belief the use is unauthorized; a statement, under penalty of perjury, that the information is accurate and that you are authorized to act; and your signature. We will remove or disable access to infringing material and may terminate repeat infringers.

10. Indemnification

You agree to defend, indemnify, and hold harmless FlightBoard and its officers, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of or related to your User Content, your use of the Service, or your violation of these Terms or of any law or third-party right.

11. Intellectual Property

The FlightBoard platform, including its design, code, and content (excluding user data), is owned by FlightBoard and protected by copyright. You may not copy, modify, or distribute any part of the Service without written permission.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL NOT BE LOST. USE OF THE SERVICE FOR AVIATION SAFETY DECISIONS IS AT YOUR OWN RISK.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLIGHTBOARD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF DATA, REVENUE, OR GOODWILL, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

14. Termination

We may suspend or terminate your account for violation of these terms, non-payment, or at our discretion with 30 days notice; violations involving illegal content or safety risk may result in immediate suspension without notice. You may delete your account at any time. Provisions that by their nature should survive termination (disclaimer, limitation of liability) will do so.

15. Governing Law

These terms are governed by the laws of the State of Washington, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of King County, Washington.

16. Changes to Terms

We may update these Terms at any time. Material changes will be communicated by email or in-app notice. Continued use of the Service after changes constitutes acceptance.
